Terms of Service
Effective Date: October 22, 2026
Product: RMedQ
Jurisdiction: Republic of India
⚠️ CRITICAL MEDICAL & EMERGENCY DISCLAIMER:
RMedQ is an administrative outpatient department (OPD) queue coordination, wait-time estimation, and digital token scheduling platform. RMedQ DOES NOT provide medical advice, diagnosis, triage, clinical consultation, or emergency dispatch services. In any acute, critical, or life-threatening medical emergency, patients must immediately dial emergency services (112 / 108 in India) or proceed immediately to the nearest hospital casualty or emergency room.
These Terms of Service (“Terms”) constitute a legally valid and binding agreement entered into under the Indian Information Technology Act, 2000 between Rashuv Technologies (“Company”, “we”, “our”, or “us”) and you (“User”), whether you are a:
- Healthcare Establishment / Clinic: Hospital, nursing home, polyclinic, diagnostic centre, or Registered Medical Practitioner (RMP) accessing administrative consoles; or
- Patient / Attendant: An individual registering for or tracking an outpatient consultation token pass.
1. Acceptance & Electronic Contracting
By accessing rmedq.rashuv.com, downloading the RMedQ mobile application, scanning a clinic check-in QR code, or checking the agreement box during clinic signup, you acknowledge that you have read, understood, and agreed to be bound by these Terms and the RMedQ Privacy Policy. If you represent a clinic or hospital, you explicitly warrant that you possess the legal authority to bind that establishment.
2. Healthcare Establishment & Doctor Terms
- Authority & Verification: Clinics warrant that all medical council registration numbers, doctor qualifications, and clinic establishment licenses submitted are genuine and active.
- Doctor Autonomy & Clinical Triage: The attending doctor retains sole, unhindered discretion to prioritize patients based on medical urgency, pediatric needs, elderly care, or clinical emergencies regardless of digital queue sequence numbers.
- Patient Communication Consent: The clinic warrants that it has collected appropriate patient consent to enter patient mobile phone numbers into the RMedQ system for transactional SMS, push alerts, and token notifications.
- Non-Clinical Boundary: The clinic acknowledges that patient diagnosis, prescriptions, and medical treatment remain strictly between the doctor and patient, and are never processed by or stored on RMedQ public token systems.
3. Clinic Subscription, 1-Month Free Trial & Billing
- Promotional 1-Month Free Trial: Qualified clinics receive full promotional trial access upon Super-Admin verification. No payment card is required upfront.
- Commercial Subscription: Following the trial period, continued platform access is subject to an active monthly subscription of ₹1,999 / month per clinic (or custom enterprise hospital terms as agreed in writing). Invoices are issued as Non-GST Bills of Supply in accordance with applicable turnover thresholds.
- Cancellation & Data Retrieval: Clinics may cancel their subscription at any time. Upon cancellation, active queue services will continue until the end of the current billing cycle, with a 30-day window provided to export historical queue reports before archival.
4. Patient & Public User Terms
- Digital Token Passes: Outpatient tokens generated via QR code or receptionist entry are temporary, daily passes for OPD queue coordination.
- Estimated Time of Consultation (ETC): ETC displayed on tokens or waiting hall screens is an algorithmic estimate calculated from average consultation velocity. ETC is not a guaranteed appointment time and may fluctuate due to clinical emergencies or complex procedures.
- Authentication: Patients must provide a valid mobile number for one-time passcodes (OTP) and queue progress alerts.
- Prohibited Conduct: Users shall not submit fraudulent bookings, hoard queue tokens, or use automated scripts to disrupt clinic queue operations.
5. Data Sovereignty & DPDP Act 2023 Alignment
In accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act):
- The Healthcare Establishment / Clinic acts as the Data Fiduciary, determining the clinical purpose for outpatient queue scheduling.
- Rashuv Technologies (RMedQ) acts strictly as the Data Processor, processing queue identifiers solely upon the lawful instructions of the Clinic.
- All clinical queue data is hosted within sovereign Indian borders on Google Cloud Platform Asia-South1 (Mumbai/Delhi) datacenters.
6. Intellectual Property
All software architectures, user interfaces, logos, brand names, and source code associated with RMedQ, RashuvMed, and Rashuv Technologies are the exclusive intellectual property of Rashuv Technologies. Your subscription confers a non-exclusive, revocable, non-transferable operating license solely during your active subscription term.
7. Service Availability & Limitations
We strive to maintain high service reliability (99.9% target uptime). However, RMedQ is provided on an “as is” and “as available” basis. We are not liable for transient disruptions caused by local internet outages, telecommunications carrier SMS delays, clinic hardware faults, or upstream cloud disruptions beyond our reasonable control.
8. Limitation of Liability
Liability Cap: To the maximum extent permitted under Indian law, the total cumulative liability of Rashuv Technologies for any and all claims arising out of the use of RMedQ shall be strictly limited to the total subscription fees actually paid by the clinic in the three (3) months immediately preceding the event giving rise to liability (or ₹1,000 in the case of free trial users). In no event shall Rashuv Technologies be liable for any indirect, consequential, punitive damages, lost clinic revenue, or clinical malpractice claims.
9. Indemnification
The clinic agrees to defend, indemnify, and hold harmless Rashuv Technologies and its directors, officers, and employees against any third-party claims, liabilities, damages, or costs (including legal fees) arising from: (a) medical diagnosis, treatment, or clinical malpractice by attending practitioners; (b) failure of the clinic to obtain patient communication consent; or (c) violation of applicable clinical establishment laws.
10. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of India. The courts of competent jurisdiction located at Saharanpur, Uttar Pradesh, India shall possess exclusive jurisdiction to adjudicate any dispute arising under these Terms.
